Withdrawal Instructions
These instructions concern consumers purchasing digital content that is not supplied on a physical medium. They explain the statutory right of withdrawal to the extent that it applies to the relevant contract under the applicable law. No additional voluntary right of withdrawal is granted. Any additional mandatory consumer rights remain unaffected. Where the statutory right of withdrawal described below applies, the following provisions govern:
Right of withdrawal
There is a right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period expires fourteen days after the day the contract is concluded.
To exercise the right of withdrawal, an unequivocal statement of the decision to withdraw from this contract must be sent to Barbara Roth, BARBARA et Co., c/o IP-Management #12433, Ludwig-Erhard-Str. 18, 20459 Hamburg, Germany; email support@barbaraetco.com; phone +49 177 6810951, for example by email or a letter sent by mail. The Model Withdrawal Form may be used, but its use is not required.
A withdrawal may also be submitted through the electronic “Withdraw from contract” function, accessible in the store’s Legal section. After submission using the confirmation function, an acknowledgment is provided promptly on a durable medium containing the statement and the date and time it was received.
The withdrawal deadline is met if the statement exercising the right of withdrawal is sent before the withdrawal period expires.
Effects of withdrawal
If this contract is withdrawn from, the seller reimburses all payments received, including delivery charges. Additional costs resulting from the selection of a delivery method other than the least expensive standard delivery offered by the seller are excluded. Reimbursement is made without undue delay and no later than fourteen days after the seller receives the statement of withdrawal from this contract. The same payment method used for the original transaction is used for reimbursement unless otherwise expressly agreed. No fees are charged for reimbursement.
The downloads offered here involve no physical goods to return and no shipping charges.
Early expiry for digital content
For a contract for paid digital content not supplied on a physical medium, the right of withdrawal ends early only if
- the seller has begun contract performance;
- the consumer has expressly consented to the seller beginning performance before the withdrawal period expires;
- the consumer has acknowledged that, through that consent, the right of withdrawal is lost when contract performance begins; and
- the seller has provided a contract confirmation under Section 312f BGB containing the contract terms and the statements about immediate supply listed above.
For the downloads offered here, contract performance begins when the download starts. Purchase, payment, or merely making a download link available or sending it does not by itself cause early expiry. Statutory rights concerning failure to supply or defective digital content remain unaffected.
Compensation for supplied content
If the right of withdrawal still exists and is exercised, no compensation for the digital content supplied up to that point is payable.
Further use after a valid withdrawal
After a valid withdrawal, the digital content may no longer be used or made available to others. Reimbursement is not made conditional on additional proof of deletion.
