Terms of Sale and Pattern License
1. Seller and scope
These terms apply to purchases of digital sewing patterns and the accompanying files described for each product in the online store operated by Barbara Roth, BARBARA et Co., c/o IP-Management #12433, Ludwig-Erhard-Str. 18, 20459 Hamburg, Germany. Contact: support@barbaraetco.com; phone +49 177 6810951.
A consumer is an individual entering into a transaction for purposes predominantly outside their trade, business, or profession. Provisions expressly identified as consumer rights apply to consumers. These terms do not restrict mandatory statutory rights.
2. Products and file language
The products are digital files supplied by download. No finished garment, printed pattern, or fabric is shipped.
The product description specifies the included sizes, file formats, instructions, and additional content. For products offered as a combined English-German download package, both languages are included in the purchase. Changing the website language does not change the contents of this package. In bilingual pattern PDFs, the language is selected through the PDF layers as explained in the accompanying instructions.
3. Ordering and contract formation
Displaying a product in the store is an invitation to place an order. After the product and, where applicable, an available variant have been selected, the item is added to the cart and checkout follows. Before the order is submitted, the information can be reviewed and corrected using the available editing functions. The process can be abandoned before submission.
Selecting the final order button, which clearly indicates an obligation to pay, constitutes a binding offer to purchase. The seller accepts the offer through an express acceptance by email. An email that only acknowledges receipt of an order and expressly does not accept it does not conclude the contract. An accelerated payment flow provides for review and confirmation of order and payment information through the steps shown in that flow.
Contracts can be concluded in German or English. After the contract is concluded, an email confirmation is provided containing the contractual information applicable to the order, including these terms, the Pattern License, the Withdrawal Instructions, and the Model Withdrawal Form. These documents are provided in full in the email or as attached PDF files and can be saved and printed. The confirmation also records the declarations actually made concerning early performance and loss of the right of withdrawal. It is sent before the download begins. A customer account does not replace this confirmation and is not required to exercise statutory rights.
After the contract is concluded, the order details and the order confirmation that was sent are stored. No separate online archive is provided through the customer account for retrieving the complete contract text, including the contractual documents applicable when the contract was concluded. The contractual documents provided by email can be saved or printed independently of a customer account.
4. Prices and payment
The total shown before the order is submitted is the amount payable, including applicable taxes. There are no shipping charges for digital delivery. The available currency and payment methods are shown at checkout. Any currency conversion or separate fee charged by the selected payment provider is governed by its agreement with the person placing the order.
Payment is processed using the method selected at checkout. The timing of supply is governed by Section 5.
5. Supply and right of withdrawal
The files are supplied through a download link. After the order is accepted and payment is confirmed, the download link is sent without undue delay to the email address provided with the order. A correctly entered email address is required. Support is available at support@barbaraetco.com if a link does not work or a file is defective. The order number and a brief description of the problem help identify the issue.
For the immediate download offered, consumers must, before placing the order, expressly consent to performance beginning before any existing statutory withdrawal period expires and acknowledge that, by giving this consent, they lose their right of withdrawal when the download begins. Both statements are made by actively checking a consent checkbox that is initially unchecked. Before the download begins, the seller provides a contract confirmation by email on a durable medium containing the contractual documents and the declarations actually made.
The right of withdrawal expires before the end of the withdrawal period only if the download has begun, the required express consent and acknowledgment have first been given, and the seller has provided the required contract confirmation under Section 312f of the German Civil Code (BGB), including these declarations. Purchase, payment, or merely making a download link available or sending it does not by itself cause early expiry. If any of these requirements is missing, an existing right of withdrawal does not expire early. Mandatory statutory consumer rights remain unaffected.
If there is no statutory right of withdrawal for the relevant contract, the seller supplies the files without undue delay after the contract is concluded and payment is confirmed. No additional voluntary right of withdrawal is granted. This does not restrict other mandatory consumer rights.
The separate Withdrawal Instructions and Model Withdrawal Form explain the applicable rights. The electronic “Withdraw from contract” function is available on the withdrawal information page.
The supplied files may be saved for personal use. Statutory obligations concerning supply, defects, and updates remain unaffected; unlimited additional online archiving is not agreed.
6. Technical requirements
Downloading requires an internet connection, access to the email address used for the order, and sufficient storage space. PDF files require compatible PDF software; ZIP files must first be extracted. The product description identifies any additional requirements, technical protection measures, and available features.
Selecting layers in a layered file requires PDF software that supports layers. Not every browser or preview app does so. Printing or projection requires a suitable printer, printing service, or projector. Pattern sheets must be printed at actual size in accordance with the instructions for the relevant file; the test square is used to check the result. Printing and projection costs are not included in the purchase price. These instructions do not restrict statutory rights concerning defective files or instructions.
7. License
The standard purchase includes a nonexclusive license to use the pattern and accompanying files for private, noncommercial purposes. Making garments for personal use and as private gifts is permitted.
Commercial use to make garments for sale or other transfer for payment is permitted only under a separate paid commercial license. This requires a prior express agreement in text form, such as by email. The scope, terms, and license fee are agreed individually. The standard purchase price does not include this commercial license. Without such an agreement, commercial use is not permitted.
Using the files as class materials or reproducing and distributing them to class participants also requires separate prior permission to the extent that authorization is required.
Inquiries may be sent to support@barbaraetco.com. An inquiry alone does not grant permission. Sending files to a printing service solely to produce personal printouts remains permitted as expressly provided in this license. Mandatory statutory permissions remain unaffected.
The files may be saved and backed up for personal, private work, printed again as needed, and the pattern adjusted for personal fit.
The following restrictions apply unless otherwise agreed individually.
Distributing, selling, uploading, or publishing the digital files or their protected contents is not permitted. This also applies to distributing copies in classes or sewing groups. Sending a file to a printing service solely to produce personal printouts is permitted; this does not give the printing service a license to use the pattern independently.
The separate Pattern License provides further explanations.
8. Statutory rights concerning digital products
Statutory rights apply if a product is not supplied or is defective. For consumers, this includes the provisions on digital products in Sections 327 et seq. of the German Civil Code (BGB). Subject to the statutory requirements, remedies may include supply, bringing the product into conformity, terminating the contract, a price reduction, or damages. Legally required updates, including necessary corrections, are supplied during the applicable statutory period, with notice of their availability.
New independent patterns, additional designs, and separately offered add-ons are not included in the original purchase solely because they are released later. Obligations to establish or maintain conformity remain unaffected. No voluntary change-of-mind return is offered after the right of withdrawal has validly expired. This does not exclude an existing withdrawal right or statutory remedies for defects.
For consumers in Australia, nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot lawfully be excluded, restricted, or modified. Support for missing or defective files, or files that do not match their description, is available at support@barbaraetco.com.
9. Applicable law
German law applies. For consumers, this choice of law does not remove the protection provided by mandatory provisions of the law of their habitual residence. Mandatory rules on jurisdiction remain unaffected.
10. Consumer dispute resolution
The seller is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration body.
11. Final provisions
If any provision of these terms does not become part of the contract or is invalid, the rest of the contract remains effective unless the law provides otherwise. The applicable statutory provisions govern in place of the affected provision.
Individual agreements take precedence over these terms.
12. Shopify platform and privacy
This online store is hosted by Shopify. Personal information is shared with Shopify and other service providers when the store is visited and purchases are made; these providers may be located in other countries. Shopify Network Intelligence is enabled and includes services that use information from interactions with this store, other merchants, and Shopify. Purposes, legal bases, recipients, international transfers, and available privacy choices are explained in the Privacy Policy. Shopify describes its own processing in its Consumer Privacy Policy. A purchase is not consent to optional analytics or advertising.
Pattern License
Private and commercial use
The right to use the pattern is nonexclusive. BARBARA et Co. may also offer the same pattern to other customers for their use. No exclusive rights to the design are acquired.
Using a printing service
The necessary file may be sent to a copy shop or printing service to produce printouts for personal use. The request must be limited to that purpose, and the service must be asked to delete the file afterward unless statutory retention is required. This does not allow the service to use the pattern independently or distribute it to others.
Files and instructions remain protected
The following restrictions apply unless otherwise agreed individually.
The protected pattern files and instructional content may not be resold, shared, publicly uploaded, or distributed as copies to sewing groups or class participants. This also applies to edited file versions containing protected content. Photographs of personally sewn garments may be shown; this does not authorize publication of the pattern sheets or instructions.
